The client agrees to carefully read and fully acknowledge the terms and conditions. The terms and conditions apply unless otherwise agreed upon in writing.
1. Scope of Application
The terms and conditions apply to all services provided by the sole proprietorship Maike Kolmer. The contracting party is anyone who has made a binding appointment/booking with Maike Kolmer.
2. Assignment
An order/booking is considered binding after the client confirms the offer and the terms and conditions via Google Docs.
3. Cancellation Policy/Compensation for Cancellations in Wedding Bookings
In case of cancellation/withdrawal by the client, the following fees must be paid from the total invoice amount to Maike Kolmer:
3.1. Withdrawal by the client without performance rendered
– 3 months before the booked date: 30% of the total must be paid
– 1 month before the date: 50% of the total must be paid
– 7 days before the date: 80% of the total must be paid
– 48 hours before the date: 100% must be paid
This applies even in cases of force majeure. If the client reschedules the appointment to another date, even due to force majeure (including pandemics), the client must coordinate with Maike Kolmer to ensure availability. If Maike Kolmer is available on the new date, no additional costs will occur. If Maike Kolmer is not available on the new date, the client will receive a voucher for the amount already paid.
3.2. Trial Appointment
Services and working hours provided during the trial appointment are fully payable.
4. Payment Terms
For bridal packages, 50% of the package is paid at the trial appointment. The remaining amount and any additional services will be settled after the wedding via invoice. All other services will be paid directly after the appointment, either at the studio or at the client’s location. The client can pay in cash, by debit card/credit card, or by bank transfer.
5. Prices
The prices according to the offer or agreement apply. Invoices are issued without VAT, as Maike Kolmer is defined as a sole proprietorship.
Travel Costs
Unless otherwise agreed, travel is charged at the standard rate of €0.80/km for round trip. If domestic travel requires arrival the day before or if the travel time to and from the location exceeds 2 hours per day, travel days will be charged based on the hourly rate, unless otherwise agreed.
6. Place of Work
The place of work must be communicated before the offer is created.
Time Planning & Preparation at the Worksite:
At the scheduled appointment, Maike Kolmer must have the agreed time fully available to complete the service on time. Changes, such as adjustments to the planned start and finish styling times, will incur a charge of €30. The worksite should be prepared prior to arrival. For “on-site location” services, a large table, one chair, one power socket, and good lighting conditions are required.
7. Client Preparation
To ensure ideal preparation and guarantee the agreed work time, the client should send a picture of themselves and their desired hairstyle and makeup ideas up to 2 days before the trial appointment. Shortly before the appointment, the client will receive a questionnaire as a reminder.
Makeup Clients
The client should already be fully cleansed. Any unwanted hair (eyebrows, upper lip) and skin flakes should be removed beforehand.
Hair Styling Clients
The hair should be washed twice with shampoo the evening before or in the morning. Please make sure it is completely dry, and do not style it with a flat iron/curling iron, etc. Please avoid using other products.
8. Cancellation by Maike Kolmer
Maike Kolmer reserves the right to charge the amount stated in the order confirmation due to a reduction in the booked services. Furthermore, appointments can be canceled by Maike Kolmer at any time for serious reasons. Maike Kolmer will make efforts to find an equivalent replacement. If no replacement is found, the client has the option to request a refund for the amount already paid, minus services already rendered, or to arrange a replacement appointment with Maike Kolmer. Maike Kolmer is not liable for any additional costs or damages arising from this situation.
9. Liability of the Sole Proprietorship Maike Kolmer
Maike Kolmer is liable, including for defect liability, only for willful or grossly negligent behavior. The client agrees to report any complaints immediately and directly on-site. No claims can be made after the service has been completed. All brushes and makeup products are hygienically cleaned. Professional products are used, and no problems have occurred to date. Maike Kolmer does not assume liability for allergies. The client is responsible for disclosing any allergies to certain ingredients in written or verbal form before booking. Any warranty claims against Maike Kolmer are excluded.
10. Maike Kolmer is entitled to change the terms and conditions as well as published prices.
11. Disclaimer: Any liability for personal injury or property damage is excluded, insofar as this is legally permissible.
